The millenium is witnessing a global decline of democracy. One of the most important aspect of this democratic erosion is the aggrandizement of the executive and its attacks against horizontal accountability mechanisms including the judiciary. However, at the same time, the elected antidemocratic leaders need courts to secure their legality and their legitimacy. The emphasis in this course would be on the place and the role of the courts in countries facing a democratic erosion. This course will introduce students to theoretical debates on this topic as well as to concepts such as judicial purge, court packing or rhetorical attacks against the judiciary.
