The prohibition of force is the cornerstone of the international legal order as established under the UN Charter. Use of force is only lawful under narrowly described circumstances. This course analyses foundational and current issues of international peace and security law, including the prohibition of force and its exceptions, the institutions involved as well as their limitations and current developments. We will also cover recent lawmaking attempts in the cyber realm, questions related to the establishment of reparation mechanisms and will also examine recent case law on the prohibition of genocide as one legal focus under which military campaigns have come under scrutiny.
Requirements: we will discuss relevant literature (academic articles; court decisions) which participants have to read in advance of each session in order to meaningfully participate in the discussions. Participants should be ready to agree to give one short text-based presentation on one of the readings.
