The Common European Asylum System (CEAS) is a dynamic and contested field at the intersection of European and international law. Shaped by the evolving jurisprudence of the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR), the CEAS raises pressing questions about justice, security, and human rights in Europe's migration governance. These challenges are intensified by the responses of EU member states to ongoing migration movements, border management, and cooperation with third countries.
This seminar examines how European and international legal frameworks address these challenges and how judicial institutions contribute to defining the limits and responsibilities of states. Discussion will focus on key issues such as reception standards, intra-EU transfers, externalisation of asylum procedures, and the substantive requirements for international protection. The CJEU's and ECtHR's case law will be analysed with particular attention to Article 3 ECHR, the principle of non-refoulement, and the EU's human rights obligations within the Schengen and asylum frameworks.
Through close reading and presentation of landmark judgments, students will critically assess the interplay between legal sources, institutions, and actors at the European and international levels. The seminar combines doctrinal and theoretical perspectives with insights from practice, enabling students to reflect on how law both shapes and responds to current challenges to justice and security in Europe.
The seminar presupposes a basic understanding of EU and asylum law. Active engagement is required through preparatory readings, individual case presentations, and group discussions.
