This course challenges a conventional typology of law through an anthropological, social-scientific lens. It examines the many forms of law that exist that do not depend on state recognition for their validity. Drawing on empirical and ethnographic work in a number of subject areas, particularly in southern African contexts, as well as on other African and Asian regions, it addresses issues such as indigenous people's rights, the construction of ethnicities and their effects, migration, labour and political participation. It examines who is 'inside' and 'outside' law in particular contexts with the consequences this entails. The course will compliment area studies as they are taught at IAAW's Department for Society and Transformation and the Department for Islam in Asian and African Studies. |
